Terms of Service

1. Acceptance

By submitting an application or accessing the 3DPrintCustomz Network, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not submit an application or claim orders.

2. Eligibility

You must be at least 18 years old, legally able to enter into binding contracts, and able to provide a valid government-issued ID. You must also have the relevant equipment + skills for the role(s) you apply for (designer, FDM printer, resin printer, painter).

3. Member Conduct

As an approved member you agree to: deliver claimed work to the standards described in the order brief, communicate professionally with the company and any buyer details shared with you, never resell or redistribute designs created for the company, and never share order details, internal tooling, or buyer information outside the network.

4. Claims, Deadlines + Penalties

Each claimed order has a deadline and an earnings amount calculated from the agreed margin. Cancelling a claimed order forfeits the earnings on that order; passing on an order after claiming it forfeits at least 50% of the earnings (on small orders the next designer is offered a minimum of $5, which can reduce the kept share below 50%). Repeated late deliveries, cancellations, or quality issues may result in temporary suspension or removal from the network at the company's discretion.

5. Payments

Earnings are paid out on the cadence specified in your member dashboard. The company is not responsible for delays caused by your chosen payout channel. Tax responsibility for earnings is yours; we will issue a 1099 (US) or equivalent where legally required.

5a. Negative Balances + Carry-Over

If penalties, refund clawbacks, or other deductions exceed your current week's earnings, the unpaid difference does not get paid out by us — it carries forward as a negative balance on your member account and is offset automatically against your subsequent earnings until the balance returns to zero. While your balance is negative, no automatic payouts are issued, and the "This Week" indicator on your dashboard turns red to make this visible.

You agree, in good faith, to clear any persistent negative balance either through your next completed orders or by voluntary reimbursement to the company. If a member abandons the network with an unresolved negative balance, or otherwise refuses to make the company whole, we reserve the right to pursue collection through all legal channels available to us, including referral to local law enforcement and civil collection, in the relevant jurisdiction(s).

6. Independent Contractor

Network members are independent contractors, not employees. You are responsible for your own tools, software licenses, taxes, and insurance. Nothing in these Terms creates an employment, partnership, or agency relationship.

7. Intellectual Property

Designs, files, and deliverables produced for an order under the network are work-for-hire and become the property of 3DPrintCustomz upon delivery and payment. You retain the right to display non-confidential samples in your portfolio with the company's prior written consent.

8. NDA + NCA

The Non-Disclosure Agreement and Non-Compete Agreement you e-sign during onboarding are incorporated into these Terms by reference and remain in effect per their own provisions even if your network membership ends.

9. Termination

Either party may terminate the working relationship at any time, with or without cause. Earnings on completed-and-delivered orders remain payable; obligations under the NDA + NCA survive termination.

10. Limitation of Liability

The network and dashboard are provided "as is". We are not liable for indirect, incidental, or consequential damages arising from your use of the network. Our maximum liability for any direct damages is limited to the earnings paid to you in the 12 months preceding the claim.

11. Governing Law

These Terms are governed by the laws of the State of Florida, USA. Any dispute that cannot be resolved by good-faith discussion will be resolved by arbitration in Pinellas County, Florida, except either party may seek injunctive relief in any court of competent jurisdiction.

12. Changes

If we materially change these Terms we will email active members. Continued use of the network after a material change constitutes acceptance.
